General Terms and Conditions
It is the
intention of GoBiddin.com to create a friendly, enjoyable and useful
buying and selling experience, but as with any transaction weather it
be online or offline there are always risks involved. We strongly
advice all of our members to understand all of our terms and policies
before joining or engaging in any activities on this or any other
internet site. If you spot a listing that is in violation of any of our
policies feel free to contact us and alert us of the infraction by
contacting us.
Rights To Suspend or Terminate.
You
agree by using this site or any of its features that GoBiddin', in its
own discretion, may terminate any auction or service without notice if
- We believe you are in violation of any policy set forth by GoBiddin'
- You have been repeatedly warned or repeatedly broken a certain term
- You have listed an item deemed suspicious or that breaks and GoBiddin' policies.
- You have been deemed a non paying bidder our we believe you have no true intentions of paying for the item(s) bid upon.
- We believe that you have a record as a non paying bidder or we believe you have no intention of paying for the item bid
Note: If we believe there has been an infraction,
the effected account/listing shall be suspended while we investigate
further. If after conclusive investigation you are found in violation
your account will be terminated and remaining account balances
confiscated.
Your Conduct.
The
responsibility of your actions in any transaction or interaction within
this website lye's solely on you. You must ensure that your
participation in selling or buying of any items does not violate any
applicable laws or regulations on any level. By this we mean that in
participating in any interaction within this website you are assuring
us that you are entitled to sell or buy any relevant item and that you
are not prohibited by any law or regulation in doing so.
You
must not transmit through this service any unlawful, harassing,
libelous, abusive, threatening, harmful, vulgar, obscene or otherwise
objectionable material. You must also refrain from transmitting any
material that would encourage by thought or force conduct that would
constitute a criminal offense, give rise to any civil liability or
otherwise violate any prescribed applicable law or regulation, whether
written or implied.
Membership.
This
site does not permit membership to individuals under the age of 18,
this is due to laws that say no individual can enter into a legally
binding contract that is under 18 years of age. If any member should
fails to sign up for membership and knowingly lies or does not include
their correct age the account will be terminated immediately, and all
account balances will be forfeited.
It is a legal requirement
for all sellers to provide their current address from which they are
trading. Any member not filling out their address or try to circumvent
the address will be suspended and will lose their right to buy or sell,
and will relinquish all remaining balances on GoBiddin'. We have
certain security measures in place to insure that scammer do not trade
her as members. If you purchase an item from a seller believed to be
conducting themselves in a malicious manor or has not reveled their
true address please contact us as a matter of urgency.
As part
of our Security review, we may ask you to provide proof of your name
and address, As GoBiddin' does not ask for Credit or Debit card
details, we may need to ask you under exceptional circumstances to fax
Documentary evidence of your name and address. This would be items such
as a Driving License, Passport, Bank Statement, Utility bill.
General Terms.
This
site is your portal in conducting auctions whether buying or selling.
We do not intend to get involved in the actual transactions between
buyers and sellers. This being the case we have no control as to
quality, safety or legality of any items accuracy, the sellers ability
sell or the ability of buyers to purchase. We cannot and do not control
whether the other party will complete the transactions.
You are
responsible for all risks in doing business on GoBiddin'. Members
accept all risks whether it be dealing with foreign nationals, underage
persons or individuals acting under false pretense. GoBiddin' shall not
be held liable for any items sold by use of this website, for damages
during transit, nor for misrepresentation of items or breach of
contract between a buyer and/or seller.
This website is not
responsible for the replacement of any item nor any losses resulting
from and goods purchased or obtained. GoBiddin' assumes no liability
for the content of any listings not listed by GoBiddin'. However if you
find yourself victim to a fraudulent transaction will will assist you
to the best of our ability.
On occasion GoBiddin' will advertise
promotions and/or special offers which would require members to
purchase in order to make all benefits to said promotion available. If
you feel such promotion was unsatisfactory then feel free to contact us
by using our contact us feature or email our staff at
admin@gobiddin.com. A refund may be given within the first 30 days
after which no refund will be given. If your account has been banned or
your account has a negative balance no refund will be due or given.
GoBiddin'
is a family friendly site, if you have any reason to be dissatisfied
with our service, then please email us Direct admin@gobiddin.com and i
will deal with the matter directly.
Adult - Over 18's
Adult
listings must be placed in the ADULT section. Various legal statutes
exist regulating the sale and distribution of pornography and adult
material, and by listing any such item at GoBiddin' you indicate your
intent and ability to abide by all applicable laws. Listings may be
removed without warning.
All members are responsible to know all
applicable laws regarding the sale and shipments of adult related items
within their prescribed region. GoBiddin' assumes no liability for any
items bought or sold within the Adult classification but will maintain
the right to remove any objectionable items from this category at will.
All items found to be breaking and applicable laws whether domestic or
foreign will be investigated and all efforts will be given to assist
all enforcement agencies in the apprehension and prosecution of the
offender(s).
Mandatory Verification.
Another
safety feature which has been is that if a member wants to place
auctions or items for sale, then they have to be verified in order to
place an item for sale or an auction. You only need to be verified the
once, and this is valid for a full year. (Checkable thereafter)
This
costs $2.00 and will enable us to check that member's personal details
with the details from the verification. This method is a lot safer and
more secure than entering your Credit card details, like other sites.
This
fee is now mandatory and non refundable and will enable the site to put
a stop to anyone even thinking of trying to scam other members. The
bonus points are that you will still have your free $20 starting Credit
and you will be able to bid on auctions that are marked for verified
users only.

These
added security elements were put in place to assist this website in
maintaining a scam free website and to assist our customers to insure
they are getting qualified customers.
Laws.
These
Terms of Service shall be governed by and constructed in accordance
with the laws of the United States of America and any disputes will be
decided only by the Courts of the United States of America.
Policies and Rules
All
policies set forth by GoBiddin' are rules and guidelines that are
intended to make GoBiddin' a safe, fair environment for all members to
enjoy. As a buyer or seller you are responsible for knowing all
GoBiddin' policies, as well as knowing all laws and regulations
applicable to your region, some of which may be specified in the User
Agreement.
GoBiddin's policies are intended to:
- Support any applicable government laws and regulations
- Minimize risks to GoBiddin' buyers and sellers
- Provide equal selling opportunities to our buyers
- Provide an enjoyable buying experience
- Support the values of the GoBiddin' Community
Violations of these policies may result in a range of actions, including:
- Listing cancellation
- Limits on/Loss of account privileges
- Account suspension/Account balance forfeiture
- Forfeiture of GoBiddin' fees on canceled listings
- Loss of PowerSeller/PowerBuyer status
Buyers cannot:
- Commit to the purchase of any item without paying or with the
intent of not buying/paying. (matters not if the user was the winning
bidder or buy with the “Buy It Now” feature)
- Any commitment of purchase show the serious intent of the member
to purchase said item, insincere bidding will be considered an
infraction.
- Misuse the bid retraction system to circumvent the bidding process.
- Bid on or buy an item with the knowledge that they have not met
all criteria set for in the sellers item listing, or bid or buy with
the sole intention of disrupting any users listing.
- Engage in shill bidding to gain attractiveness for any users
listing making it seem more desirable thus increasing bid for such
listing. All bidders must remain independent from the sellers of that
item. The co-seller feature is not intended to circumvent the proper
use of the bidding system as such any user deemed to be engaging in the
process will be immediately suspended.
Seller's cannot:
- List items that have
been prohibited by any governing body. You are responsible for know
what items are illegal to sell in your area.
- List items that have the potential of violating certain copyrights, trademarks, or other rights.
- List items with a payment forms not accepted by GoBiddin'
- Not honor the agreed transaction.
- Fail to deliver an item which payment has been made.
- Misrepresent an item by not meeting terms and item description laid out in the auction listing.
- Refuse to accept payment for an item in which a successful sale has been made.

Engage in shill bidding (bidding on your own item), or have a
family member, roommates or employees bid on their item to raise the
price or make the item more desirable.
- File for Final Value Fee credits on any transaction that the buyer has already paid.

Fail to pay any taxes related to their listings or “Buy It Now”
transactions .buyers to mail cash or use other payment methods not
specifically permitted by GoBiddin as accepted payment methods.
- Communicate to buyers that they accept, or will not accept, specific forms of PayPal payment.

Include links that do not conform to GoBiddin's Links Policy.
Specific types of links that are limited include links to further
descriptions, email address, photos, your About Me page, listing terms
and conditions and GoBiddin' Stores.
- Use certain types of HTML and JavaScript in item listings, Stores pages, About Me pages, or Want-It-Now ads.
- Promote giveaways, random drawings, raffles, prizes or bonuses.
- Create a listing that does not offer an item or service.
- Advertise a desire to buy or trade items, except as allowed in non-binding bid categories and in Want It Now.
- Include third-party endorsements of GoBiddin members.
- Include third party credits beyond what is acceptable.
- Create test listings except in the Everything Else; Test Auctions category.
- Use profanity in a listing, except as allowed in the Mature Audience category and in media titles.
Listings Cannot:
- Be listed in inappropriate categories.
- Misrepresent the item location from which their item will be shipped.
- Include brand names or other inappropriate keywords in a title or description. This is known as keyword spamming.
- Have misleading titles that do not accurately describe the item for sale.
- Offer a catalog from which buyers may directly order.
- Allow buyers a choice of significantly different items
- List a single item but offer additional identical items for sale in the item description.
- Include separate payment surcharges that buyers pay to use ordinary forms of payment.
- Misuse the Reserve Price option.
- Charge excessive shipping.
- Offer the opportunity through GoBiddin to purchase the item or other merchandise outside of GoBiddin.
- Use their About Me Page to promote outside-of-GoBiddin sales or prohibited items.
Prohibited and Restricted Items – Overview
Before
any seller lists an items they first need to be sure that their item is
allowed to be listed on GoBiddin' and if said item is subject to any
restrictions as to avoid any potential issues with the listing. As a
seller on GoBiddin' it will always your responsibility to make sure
that any items you sell are legal in the eyes of all governing entities
in which you conduct business.
Violating these policies may result in, but not limited to the following actions:
- Cancellation of violated listing
- Limitations on account privileges
- Suspension of violators account
- Automatic forfeiture of GoBiddin' fees and account balances
- Loss of PowerSeller and PowerBuyer status
If
and when a violation of any of GoBiddin's policies occurs, GoBiddin'
will email the effected seller, as well as the bidders of the listing,
as to the ending of the listing. Effected members may contact GoBiddin'
by using our Dispute Resolution or Contact Us links found on most pages
of this website.
Understanding the rules about prohibited and restricted items

Policies governing listings often times are based on various country
and state laws. Many restrictions also involve the sale of dangerous
and often time sensitive items, which may not necessarily be deemed
illegal or prohibited by law. You as a seller are solely responsible to
know your governing laws. However GoBiddin' has set up some policies
regarding these items, see Offensive Materials Policies.
- When
selling to buyers from outside the country in which you reside, be
aware of all international trading and importing restrictions.
Allthough an item may be perfectly legal in your country it may be
illegal in another.
- The fact that an item is listed below, alone
does not mean that is it totally prohibited. There are in some cases
exceptions to this rule. For example in the Medical Devices Policy,
here there are many items that are not prohibited but many others are.
Note:
All examples are designed to assist our sellers to stay in compliance
and should not be misconstrued as being an exhaustive or complete list.
When in doubt, check with your governing body as to the legality of
your items.
It is also important to familiarize yourself
with the Rules for Listings and the Rules about Intellectual properties
to be sure that there are not further regulations on your items.

Accepted Payments Policy
We at GoBiddin'
want to be sure to offer our buyers and sellers a safe way to buy and
sell their goods. That is the motivation for everything we do at
GoBiddin'. This has prompted us to set up the Accepted Payments Policy.
GoBiddin'
encourages sellers to offer payments through PayPal. PayPal is
convenient to use and has privacy built in. We have many other options
available to our sellers that offer a secure method of payment.
Some
offline payment methods, such as personal checks, may not offer the
same level of protection or convenience as online payments.
Sellers may be required to offer PayPal or a merchant credit card as one of the payment methods for a specific listing.
Permitted on GoBiddin.com:
Sellers may offer to accept:

PayPal, merchant credit cards (including MasterCard, Visa, Amex,
Discover® Network), debit cards, and bank electronic payments for
auction purchases.
- Bank-to-bank transfers, often known as bank wire transfers or bank cash transfers.
- Cash on Delivery (COD) or cash for in-person transactions.
- Personal checks, money orders, cashier's checks, certified checks, and other negotiable instruments.

Buyers to send cash or money orders through instant cash transfer
services (non-bank, point-to-point cash transfers) such as Western
Union or MoneyGram.
Not permitted on GoBiddin.com:
Sellers may not solicit:
- Buyers to mail cash. Payment through "topping off' of a seller's pre-paid credit or debit card.

Asking buyers to avoid payment processing or other methods to
circumvent fee payments for services rendered through GoBiddin.com.
- Payment through online payment methods not specifically permitted in this policy.
Misleading & Discouraging Payments
If
a sellers listing states that they will in fact honor a certain payment
method as payment it is against policy to discourage buyers from using
that payment method for any reason.
This means that if a seller
lists a certain form of payment as expectable in their Payment Details
section of their listing, including but not limited to PayPal, must not
act or insinuate in any way that they discourage or will not except
that method of payment.
This policy is not only limited to
communications made in listings, but also includes all correspondence
between a seller and buyer that relates to a GoBiddin' transaction.
Violations of this policy may result in a range of actions including but not limited to
- Cancellation of violating listing
- Automatic forfeiture of listing fees on violating listing
- Immediate limits on account privileges
- Loss of PowerSeller and/or PowerBuyer status
- Account suspension
- Forfeiture of account balances
To report a policy violation:
- Locate and review the policy page that deals with the violation.
- Click the "Abuse Report" link in the All Buying section member's area or "Contact Us" link on the bottom of all pages.
- Enter the user name(s) and item number(s) of the listing(s) you wish to report.
- Click the Send button to send your message to GoBiddin' Customer Support.
Note: Only report a case once. Multiple emails about the same case slow an investigation. After your report is received:
- GoBiddin' will consider the circumstances of an alleged offense and the member's trading record before taking action.
- If a complaint can't be proven with certainty, GoBiddin' may take no action.
- Due to user privacy issues, it is not possible for GoBiddin' will not discuss the results of an investigation.

Posts made in GoBiddin's Want It Now area must also comply with

Reporting Inappropriate Trading Behavior
The
GoBiddin' Investigations team tries to resolve reported cases of
inappropriate trading behavior. GoBiddin' will consider the
circumstances of an alleged offense and the user's trading record
before taking action. Disciplinary action may range from a formal
warning up to indefinite suspension of a user's account. However, out
of fairness to all users, if a complaint cannot be proven with
certainty, GoBiddin' will not take action.

Make sure that your complaint relates to a subject that GoBiddin'
investigates by reviewing the offenses explained on this page.
- When you contact GoBiddin', please include the information we need to
investigate, plus any emails with full descriptions in the subject line.
- Only report a case once. Multiple emails about the same case will slow the investigation.

Once you notify the Investigations team, GoBiddin' may contact you
to tell you the investigation is complete. However, please remember
that because we respect the privacy rights of all our users, GoBiddin
can't discuss results in detail.
- To report a listing, use the
"report" links on the policy pages that are applicable to the offense.
For example, GoBiddin' prohibits email offers to buy or sell listed
items outside of the GoBiddin' Web site. To report a seller offering to
sell you items outside of GoBiddin', you would go to the Offers to buy
or sell outside of GoBiddin' policy page and use the "contact GoBiddin'
link.
What GoBiddin investigates:
- Violations of GoBiddin' policies may result in a range of actions, including:
- Listing or Want It Now post cancellation
- Limits on account privileges
- Account suspension
- Forfeit of GoBiddin' fees on canceled listings
- Loss of PowerSeller status
Note:
GoBiddin' will not remove Feedback from your profile unless there are
exceptional circumstances. Please review GoBiddin' Feedback Removal
Policy for details.
Buying offenses:
- Transaction interference
- Offers to buy or sell outside of GoBiddin'
- Invalid bid retraction
- Unpaid Items
- Unwelcome bidding
- Shill bidding
Selling offenses:
- Shill bidding
- Sell non-performance
- Offers to buy or sell outside of GoBiddin'
- Circumventing fees
Note:
If you offered an item on GoBiddin' and did not receive payment from
the purchaser, you may sell the item to another bidder using Second
Chance Offer.
Contact information and identity offenses:
- Misrepresentation of identity
- False or missing contact information
- Dead/invalid email addresses
- Underage user
Note:
While multiple User IDs are allowed, it is never permissible for those
User IDs to interact with one another. For example, members cannot bid
on their own auctions or leave comments on their own Feedback Profile.
Miscellaneous offenses:
- Interfering with GoBiddin' site and/or operations
- Sending spam
- Email threats
- Publishing contact information
- Use of profanity or patently vulgar language
What GoBiddin' does not investigate:
GoBiddin'
doesn't investigate simple misunderstandings, failure to communicate,
and interpersonal disputes over which GoBiddin' has no control. Here
are some examples of other things that GoBiddin' doesn't investigate:
- Feedback issues
- Shipping cost issues
- Honoring of selling transactions
- Honoring of buying transactions
- Bid Sniping (last minute bidding).
- Almost everything else that is not in the list of offenses, we will investigate.
Any
technical questions, billing questions, etc., should be sent to the
appropriate email address to avoid delays. You may find the proper
contacts using the "Contact Us" on the bottom of any page in the
GoBiddin' system.
